Exercise and Cancers: Research Opportunities for Health-Related Fitness ScientistsRepresentatives from the American Cancer Society (ACS), the National Cancer Institute (NCI), and the Centers for Disease Control (CDC) will challenge AAHPERD members to contribute to cancer prevention and control, describing the most promising research opportunities and resources to support investigation of the relationships between cancers and exercise. The presentation will be based on a synoptic article being developed by the ACS and the Office for Health Promotion of Northern Illinois University. Ruth Corcoran of ACS will describe a proposed collaborative research agenda, suggesting that two sets of consensually developed guidelines are needed to promote such research: one set to facilitate dissemination of what experts already know to the public and providers (including exercise specialists); and a second set to facilitate further collaborative research. Speakers from CDC and NCI will outline what is known about these topics, and how exercise scientists can contribute to further development (see accompanying abstracts). Presenters will recommend a process to develop research priorities, involving cancer experts, public health scientists, and relevant interest groups in AAHPERD. DICK YORK: Committing our office to a computerized property management system a few months ago, I shopped for the right software. Altogether I looked at about ten different property management systems. I made a list of my minimum requirements, then eliminated some systems just from reading the brochures. Yardi Systems brochure was suspicious; it claimed to do too many things too cheaply. Finally, I called Yardi anyway. Al Yardi answered the phone. I liked that. My questions were answered. I had found a program that was user-written. I like vertical applications that are user-written. Every programmer claims his program is user-friendly, which means your check is in the mail. Professional programmers usually have no idea what u sers reallyu need. Al is a real estate broker, a property manager who wrote this program to fill his own needs. The program is simple and adequate. We found a glitch, but an update was promptly sent. Since then it has never failed us. Yardi Systems would not be adequate for a large professional property management company, but is more than ample for a smaller company or individual owner. It expands easily and can accommodate as many accounts as you wish. It writes checks, including recurring payables; gives you vendor year-to-date totals, which is basically the 1099. It has a compressed mode of printing which allows 8-1/2 x 11 paper. It will produce a customized message on tenant statements. On and on. We use it to track payments on notes, mortgages, and land leases as well. Yardi didnt design it for this, but the system is flexible enough to alter for your own accounts.

Health Alliance Medical Plans last month announced its coverage of two over-the-counter drugs formerly available by prescription only: Wyeths Alavert and Procter Gambles Prilosec OTC. Developing a “Culture of Safety” A year ago we wrote about the complex process involved in identifying, categorizing, and assessing medical error in health care in the United States (”Assessing Medical Error in Health Care,” Health Progress, November– December 2001, pp. 14-17). That article discussed the 1999 Institute of Medicine (IOM) report on medical error, “To Err Is Human,” and the erosion of public trust in U.S. health care.
Part II, explanatory economics, represents the bulk of the book. The economics of demand, price elasticity, risk aversion, and the effect of insurance on the demand for medical services are explained clearly and well. Behavior of suppliers in the medical care market is reviewed, with attention given to differences in for-profit and not-for-profit organizations. A solid explanation of competitive markets allows discussion of timely issues such as the limits of applicability of the competitive model to the medical care market, price and nonprice competition, and market power of providers, purchasers, and patients. Outside readings on current managed competition proposals would augment the textbook discussion well.A short section on the economic effects of information asymmetries in the medical care and health insurance market introduces the concepts of supplier induced demand and adverse selection. Both discussions are short, but the portion on adverse selection especially needs expansion. More rigor, explanatory graphs, and a more extensive bibliography would make the adverse selection concept more useful. This topic is critical to a sound understanding of the functioning of medical expense insurance.The final section deals with value judgments and evaluative economics. The nontechnical explanation of efficiency versus fairness criteria for evaluating medical care policy is somewhat cursory. More technical material is needed to improve the precision of this discussion. However, even without any additions, the text provides a general background on issues of access to medical care, affordability, and quality of care. The difficulty of making allocation decisions given scarce resources is clearly laid out and opens the way for a discussion of policy alternatives.

Real estate practice is a broad and widely defined area of the law. In a pristine sense it deals with the esoteric subject of real property law and titles. In practice the subject matter handled by real property lawyers is much broader. Many of the areas of law within real estate practice are areas of specialty themselves. Real estate lawyers examine and evaluate real property titles, handle real estate sales, purchases and other transactions, foreclose mortgages, represent developers and contractors in drafting and negotiating development and construction agreements, handle real estate financing, structure and draft the governing documents for planned developments such as condominiums, serve as counsel to community and condominium associations, draft and negotiate leases, litigate title, boundary, and other land disputes, and advise clients respecting zoning and land: use matters. The examination of real estate titles requires knowledge of corporations and other forms of business organization, wills, trusts and estates, and a practitioner handling transactions must understand contractual, business, and tax subjects as well. The subjects that are tested on the certification exam attest to this diversity. They are title issues; real estate finance; environmental and land use; condominiums and homeowner associations; landlord tenant; closings; sellers, buyers, brokers, and title insurers; real property litigation; taxation of entities and other tax issues; and ethics. Some hold an impression that at least some aspects of the real estate practice are not challenging, that the practice is increasingly title company, form, and paralegal driven, and that when business is light any lawyer with a good paralegal can Ado real estate closings. This impression is not accurate. As with any area of practice, successfully representing clients in real estate matters requires knowledge, skill, and experience. The diversity in real estate practice may mean that no one lawyer can be an expert in each practice area encompassing the modern real property practice or that are tested by the certification program. That, however, is not a reason to not seek certification. The committee recognizes that few lawyers are likely to possess specific and detailed expertise in each of the many subjects that fall within the scope of real estate.

FACE-LIFTS, and surgical procedures to make the face look younger, are nothing new. Medical techniques that have made them a reality are fairly recent, but mythological texts spanning many centuries and many cultures (from ancient India to Hollywood) have imagined what the consequences might be if those who wished for a new face were to get what they wished for. Contemporary accounts of cosmetic surgery differ in many ways from mythological treatments of the theme; where the modern technique constructs a new face ex nihilo, most myths imagine the exchange of one face for another, existing face. Both sets of stories, however, frequently express the desire to have not just any face but ones own face as it once was in the past–to masquerade as ones younger self, as it were. And the myths, at least, demonstrate that this is a foolish, impossible, or even fatal desire. It is my contention that the myths are right, and that the lessons they teach should be taken seriously by people contemplating real, surgical face-lifts. Many myths about face-lifts were conceived by cultures far from the worlds of cosmetic surgery in Europe or the United States. Here is a story from a late medieval Indian Sanskrit text: Parvati is a woman divided against herself–or, rather, a woman forced by her husband to divide herself into two polarized halves. Shiva likens her to a black snake when he teases her, and like a snake she sloughs off her black outer sheath to reveal her golden inner form. The creation of a double is her solution to the problem of Shivas womanizing (more precisely, goddessizing); insulted and rejected, she walks out on her unfaithful, hyper-critical husband. But she does not stay away for long: Eventually she sends back a more acceptable form of herself, the golden goddess. The chopped off, negative Kali is banished to the liminal area of the Vindhya Mountains (the southern region that composers of the ancient Sanskrit texts in the northwest of India regarded as beyond the Hindu pale, the place to dump things that you did not want in the story any more); the remaining golden form becomes the female half of the androgyne. I have discussed elsewhere (Doniger, 2000) the apparently racist aspects of this myth; ancient Indian authors did not have a recognizable concept of race, though they did have negative ideas about people with dark skin, whom they sometimes regarded as lower-class or even out-caste. But we cannot ignore the parallels with the uses of cosmetics in our own day to change characteristics stereotypical of race–hair straightening, light makeup, and, of course, the surgical transformations of Michael Jackson.

Having religious significance Christmas also celebrates the child found in each individual and the desire for peace. Falling during the same month as the Jewish observance of Chanukah or Hanukkah (the Feast of Lights) and the African-American celebration of Kwanzaa the season of Christmas serves as a time of celebration feasting and a search for miracles.While Christmas generally is considered the celebration of Jesuss birth the early Puritans who settled the New England region refused to celebrate the occasion. Disagreeing with the early church fathers who established the holiday around a pagan celebration for easy remembrance by the poor the Puritans considered the observance secular in nature. Set during the winter solstice when days grow dark early Christmas coincides with the Roman holiday of Saturnalia; the date December 25 marks the celebration of Dies Natalis Invicti Solis or the birth day of the Unconquered Sun by the Romans. Puritans believed that these pagan customs which included no work feasting and gift giving were inappropriate for the celebration of the Lords birth. While the northern colonists did not observe the day the southern colonists celebrated in much the same style as their British counterparts–with banquets and family visits. Firecrackers or guns were used to welcome the Christ Child at midnight on Christmas. The residents of New York (New Amsterdam) celebrated the season in a similar fashion as their Dutch ancestors had with St. Nicholas Day (December 6) established to honor the patron saint of children. Gradually all observances became centered around the date December 25 with traditions becoming mixed and accepted between different ethnic backgrounds.

for Christmas” do you feel like the real question is, “Have you finished
your Christmas shopping?” Has the exchange of “presents” begun to interfere
with your ability to be truly “present” at Christmas time?

MY MARRIAGE IS AN ABOMInation. An Ohio churchs sign in the spring 2006 issue of Conscience said so, and we all know the church is always correct. They have that red phone that connects directly to up above, right? No, I am not gay. Neither is my wife. The sign said a marriage for any reason other than love and procreation was an abomination. Gays love each other as much as straight people. The reason the union of a same-sex couple is an abomination must be because they cant procreate. Most states do not allow same-sex marriage. If this is all about offspring, perhaps we should take the next step: Require the betrothed to pass fertility tests before they can get a marriage license. Of course, this means that postmenopausal ladies will be unable to wed. This also brings up the question of what to do about couples who are already married and become sterile. Can they stay married if they have children, even though they cant have more? If you dont reproduce within 10 years of your wedding date, should your marriage automatically expire? Same-sex couples can adopt, and lesbian couples can even be pregnant at the same time–double the production capacity, of a heterosexual union. This apparently doesnt count as being able to procreate.

This month, Rockstar Games, the maker of the video game series Grand Theft Auto, launched Bully, a game with themes of school fighting. In March, Floridas Miami-Dade County School Board called on retailers not to sell the game to minors and required the school district to warn parents about the potentially harmful effects of playing violent video games.
Literature Review PEDIATRIC/ADOLESCENT CARE * Bullying Glew G, Rivara F, Feudtner C: Bullying: Children hurting children. Pediatr Rev 2000; 21(6):183-89. The authors outline effective methods of questioning to identify victims and bullies; to encourage parents to organize a meeting between school representatives, all parents, teachers, and the school psychologist; to give children strategies for bullying encounters; to encourage families and teachers to continue to communicate; and to follow children who may develop serious emotional problems that require psychotherapy referral.

In general, children who become the targets of bullies have a negative view of violence and go out of their way to avoid conflict. They tend to be “loners” who exhibit signs of vulnerability before being singled out by a bully. Being victimized leads these children–who are already lacking in self-esteem–to feel more anxious and thereby increase their vulnerability to further victimization. Being the target of a bully leads to social isolation and rejection by peers, and victims tend to internalize others negative views, further eroding their self-esteem. Although bullying actually lessens during adolescence , that is the period when peer rejection is most painful for victims. In a number of well-publicized cases (in Scandinavia, Japan, and Australia, as well as the United States), adolescents tormented by bullies have been driven to suicide .


Evidence indicates that bullying is not a phase a child will outgrow. In a long-term study of more than 500 children, University of Michigan researchers discovered that children who were viewed as the most aggressive by their peers at age eight grew up to commit more (and more serious) crimes as adults. Other studies indicate that, as adults, bullies are far more likely to abuse their spouses and children.

The aim of this decision is to retain the resources in the business that are required to run the business or make additional investments in the business, as long as the returns earned exceed the required return. In theory, management should return or distribute all resources that cannot be invested in the business at levels in excess of the required return. In practice, however, dividends are often maintained at or changed to certain levels in order to convey the proper signals to the investors and the financial markets. For example, dividends can be maintained at moderate levels to demonstrate stability, maintained at or reduced to low levels to demonstrate the growth opportunities for the business, or increased to higher levels to demonstrate the restoration of a strong financial (capital) structure (debt and equity capital) for the business.Capital is the total of financial resources invested in the business. In terms of the sources, there are two types of capital: interest-bearing debt funds, such as loans, bonds, short-term notes, and interest-bearing payables to trade suppliers; and equity, such as common and preferred stock and the earnings retained in the business that add to stockholders share of the entities. In terms of uses, there are also two types of capital: net working capital, such as operating cash, inventory, and receivables, less interest-free payables to trade suppliers; and fixed capital, such as property, plant, and equipment. Capital is managed to maximize wealth by maximizing the rates of return on investments of capital and thus maximizing the total net present value of the business. This can be done by minimizing the amount of capital used for given business investments with given business returns.Weighted average cost of capital is the weighted average of the returns on investment or future dividends for the stockholders and interest rates on debt for the creditors. This average return should be used as the required return for investments, as mentioned earlier, because it represents the weighted average of the required returns of all the different debt creditors and equity investors. It also represents the weighted average of the costs that can be saved by the business if the resources or financial funds are returned to the creditors and investors instead of being used for investments within the business.

Working in collaboration, RONA and the Vancouver Organizing Committee for the 2010 Olympic and Paralympic Winter Games (VANOC) partnered with community organizations to set up the Fab Shop, where small wood products required at the Olympic and Paralympic venues are built. The Fab Shop is also host to the delivery of a community-based training program providing carpentry skills training and supported job experience to individuals who have yet to successfully enter the workforce. The program is taught by a Red Seal-certified carpentry instructor and three supervising carpenters. It is certified by the Industry Training Authority (ITA), the agency overseeing British Columbias industry training and apprenticeship system. A total of four groups of trainees will go through the Fab Shop 30-week carpentry training program until 2010.

“As a National Partner of the Vancouver 2010 Olympic and Paralympic Winter Games, RONA is truly helping build Canadas Games,” said Michael Brossard, RONAs Senior Vice President of Marketing. “Community-based programs such as the Fabrication Shop are a great example of how we can contribute not only towards building Olympic and Paralympic venues but to building lives as well.”

An inquiry into the death of Darren Denholm has severely criticised the doctor and two dentists involved and has recommended that they be reported to their professional organisations for disciplinary action. He recommended that action be taken to end the use of general anaesthesia outside hospitals equipped with resuscitation facilities. The Scottish health minister, Susan Deacon, responded immediately by promising to introduce such a ban. I share the sheriffs concerns, and that is why I have asked my officials to work with clinicians to phase out the use of general anaesthetic in these circumstances as soon as possible, she said. The inquiry report also criticised the decision taken by the General Medical Council in 1997 to grant Dr Evans-Appiah full registration despite a history of problems related to his competence. Doctors at Borders General Hospital raised concerns with the GMC in the early 1990s after becoming concerned about the standard of his work. He was later sacked by Falkirk Royal Infirmary in 1993 after he administered the wrong drug to a woman after a caesarean section. Experts at the fatal accident inquiry described his anaesthetic practices as dangerous, bizarre, inappropriate, and inept.

FEBRUARY IS National Pet Dental Health Month, and for good reason. Just like humans, the dental health of our pets is directly linked to their general health and quality of life. According to the American Veterinary Dental Society, our pets dental health is the most overlooked aspect of their care, and more than 80 percent of dogs and 70 percent of cats show some signs of gum disease by age 3. We cant check the sink for pink when it comes to our dogs and cats, so what exactly should we be looking for when checking an animals mouth for dental problems? The most common symptom of dental problems in our dogs and cats is bad breath. But dont rely on the breath test alone. The best thing to do is to pull up their lips and look at their teeth and gums. The gums, especially the gum closest to the base of the tooth, should be a healthy pink color and there should be no swelling or bleeding, which would indicate gingivitis. Healthy teeth should be white, not yellowed or discolored, and you should not see any evidence of tartar buildup on the teeth or at the gum line. When doing this exam, check for broken or chipped teeth. If you notice any problems at all, schedule an appointment with your vet so he can examine and treat any problems.

They argue that, if marijuana, cocaine, heroin, and other drugs were legalized, several positive things would probably occur: (1) drug prices would fall; (2) users would obtain their drugs at low, government-regulated prices, and they would no longer be forced to resort to crime in order to support their habits, (3) levels of drug-related crime, and particularly violent crime, would significantly decline, resulting in less crowded courts, jails, and prisons (this would allow law-enforcement personnel to focus their energies on the “real criminals” in society); and the drug production, distribution, and sale would no longer be controlled by organized crime, and thus such criminal syndicates as the Colombian cocaine “cartels,” the Jamaican “posses,” and the various “mafias” around the country and the world would be decapitalized, and the violence associated with drug distribution rivalries would be eliminated. By contrast, the anti-legalization camp argues that violent crime would not necessarily decline in a legalized drug market. In fact, there are three reasons why it might actually increase. First, removing the criminal sanctions against the possession and distribution of illegal drugs would make them more available and attractive and, hence, would create large numbers of new users. Second, an increase in use would lead to a greater number of dysfunctional addicts who could not support themselves, their habits, or their lifestyles through legitimate means. Hence crime would be their only alternative. Third, more users would mean more of the violence associated with the ingestion of drugs. These divergent points of view tend to persist because the relationships between drugs and crime are quite complex and because the possible outcomes of a legalized drug market are based primarily on speculation. However, it is possible, from a careful review of the existing empirical literature on drugs and violence, to make some educated inferences.

Liotta said North Koreas linking humanitarian assistance to continuing recovery operations caused the Berlin talks to end without reaching any agreement on technical issues such as the timing and procedures for recovery work next year, but he hopes talks will resume in January.

Scottish Highland Hotels met the forecasts it made at the time of last Novembers flotation, reporting pre-tax profits for the year to October of pounds 2.13m, a 50 per cent increase on the previous year. The companys shares, which were placed at 125p, closed 2.5p higher yesterday at 152.5p. Scottish Highlands bumper profits followed a rise in the Glasgow-based companys occupancy rate from 73.4 to 75.5 per cent during the year and a jump in the room rate charged from pounds 47.78 to pounds 49.83. Pro forma earnings per share rose 24 per cent to 10.3p and a dividend of 0.5p was announced, although the company said it would have paid 3p had the shares been listed for a full year. The successful flotation of Scottish Highland followed hot on the heels of the withdrawal of the planned flotation of Principal Hotels after a glut of hotel floats in 1996.
Scottish Highland Hotels shrugged off the shelving last week of rival Principal Hotels planned flotation. It is pressing ahead with its own market debut next month and yesterday signalled its confidence by sticking with the placing price of 125p a share it settled on in September. With six hotels in Scotlands central belt and only 525 bedrooms, Scottish is small even by the standards of the overpopulated, fragmented hotel sector. Its biggest challenge will have been persuading investors that it has anything different to offer but sources close to the float say the placing, to raise pounds 13m, was twice subscribed. At the placing price, Scottish will be valued at pounds 30.4m, just 12.4 times post-tax earnings, making it one of the most cautiously priced issues. The company said it would have paid a full-year dividend of 3p, representing a gross yield of 3 per cent. The former fiefdom of the Fimmers family, which remains a sizeable shareholder, the company fell on hard times in the recession and management control was relinquished to the professional operations team who had previously reported to the family. Hamish Grossart was brought in as chairman. They transformed the company from a family plaything to a more focused business venture and since 1993, operating margins have risen from 21 per cent to a forecast of more than 30 per cent in the year ending tomorrow. Profits for the period just closing are estimated at not less than pounds 2.1m from sales of pounds 16.5m, up from the pounds 1.4m recorded last year before a one- off chunky exceptional gain that distorted the reported figure. Back in 1993, profits of only pounds 242,000 were made from sales of pounds 14.9m. When dealings start on 11 November, Scottish should get off to a healthy start. Thereafter it will have to take its chances in a seriously overcrowded market.

BALTIMORE - What difference does a year make? Ask a bankruptcy attorney. A year after the implementation of the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005, bankruptcy filings are still significantly off from what they were before the new law took effect last October. “I can tell you I didnt see any clients between October 17 and the end of last year,” said Baltimore lawyer Mark F. Scurti, who handles Chapter 7 and 13 bankruptcy cases.
But a Maryland bankruptcy attorney said it is too soon to know the true effects of the law, especially with the surge of filings before the change.I think you need more experience before you start taking shots and drawing conclusions, said Lawrence D. Koppel of Gordon, Feinblatt Rothman, Hoffberger Hollander LLC in Baltimore.The federal law, which went into effect in October, aimed to reduce abuse of the bankruptcy system by those who could have paid their debts. Under the measure, consumers must get credit counseling before filing for bankruptcy and have their ability to pay debts investigated.Backers of the study said they wanted to counter the notion that the law was working. Anecdotally, they acknowledged, the number of bankruptcy filings had dropped, though official case counts since the change are not yet available from the Administrative Office of the U.S. Courts. But researchers attributed the decrease to a surge in filings before the deadline last year and a growing notion among consumers that bankruptcy is no longer an option.The report looked at 61,355 consumers who had visited six credit-counseling firms since the law went into effect. The firms reported that 97 percent of those clients were unable to repay any of their debts, and that four out of five would-be filers found themselves in troubled financial circumstances because of events beyond their control.Study backers also said they wanted to dispel the idea that filers were merely deadbeats living beyond their means. One East Coast credit counselor said consumers seeking pre- bankruptcy counseling at her firm included an elderly Midwestern woman who had moved into her kitchen because she couldnt pay the heating bill, and a Florida single mother and four sons, including one with cancer These are real people. For most of them, they are at their worst financial condition in their lives, said Leslie E. Linfield, executive director of the Institute for Financial Literacy, a nonprofit credit counseling business based in Portland, Maine.The law change, which added work for bankruptcy attorneys, has driven up legal fees by 50 percent, the group said. Consumers also face new costs from the mandatory education courses. Credit- counseling courses needed before filing cost an average of $50. A second financial education course required before exiting bankruptcy can cost another $25 to $50, study backers said.They have done nothing more than put more hurdles in the path of those who are already on their back, said Brad Botes, executive director of the National Association of Consumer Bankruptcy Attorneys, during a conference call. Botes predicted the number of filings would soon return to the levels seen before the change.Congress got bankruptcy reform wrong. Dead wrong, he added.

The presentation will be based on a synoptic article being developed by the ACS and the Office for Health Promotion of Northern Illinois University. Ruth Corcoran of ACS will describe a proposed collaborative research agenda, suggesting that two sets of consensually developed guidelines are needed to promote such research: one set to facilitate dissemination of what experts already know to the public and providers (including exercise specialists); and a second set to facilitate further collaborative research. Speakers from CDC and NCI will outline what is known about these topics, and how exercise scientists can contribute to further development (see accompanying abstracts). Presenters will recommend a process to develop research priorities, involving cancer experts, public health scientists, and relevant interest groups in AAHPERD.
